Karachi: Tausif Hanif, Editor of local English Newspaper "Yahoo News" has demanded of the Federal, Provincial to issue directions for the withdrawal of 20 false criminal and civil cases which were filed by the then Chief Controller of Karachi Building Control Authority Rauf Akhtar Farooqui against the Yahoo News and him just to victimize and pressurize him .
Addressing a press conference at Karachi Press Club, Editor of Yahoo News Tausif Hanif told the newsmen that he has been working in prominent newspapers for more than 15 years and he started publishing Yahoo News nearly one and a half year ago. Various factual reports were published in the Yahoo News about the alleged corruption of KBCA Chief Rauf Akthar Farooqui and his subordinates with substantiated proofs, he added.
To victimize the Editor of newspaper, Chief Controller of KBCA filed a false criminal proceeding case in the Court of Judicial Magistrate South Rubab Fatima and by using the alleged "chamak" of the lower staff of the lower courts Chief Controller managed to get arrest warrant of Editor of Yahoo News. But the Editor got the bail before arrest from the competent honorable court in that criminal case.
After that Chief Controllers and his subordinates officials (on the direction and pressure of Chief Controller) filed 19 cases in Sindh High Court and other courts of Sindh just to corner and pressurize the Editor of the newspaper, he further told the newsmen.
In all the criminal and civil cases, KBCA officials have alleged that Editor of Yahoo News has defamed them by writing the alleged corruption of the KBCA officials.
These officials claimed that their neighbors, friends and even family members have isolated them only due the publication of alleged corruption of KBCA in the Yahoo News. Its worth mentioning that Son of One KBCA senior Official was arrested in UK for Kidnapping for ransom and he was deported to Pakistan and was eventually booked in ransom case by Karachi Police. That senior official also filed defamation case and claimed that he was defamed due to the publishing of list of illegal Constructions in Yahoo News
The officials of KBCA, who filed cases against the Editor of Yahoo News prayed to the courts that the Editor of Yahoo News should be arrested and penalized with maximum physical and financial punishment.
It may be noted here that all those officials who filed cases against the Editor of Yahoo News were many times suspended and even removed from the services on corruption charges in the past. Even the Chief Controller Rauf Akther Farooqui was suspended and sacked from the Service in 1997 by the orders of the then Chief Minister of Sindh Abdullah Shah on corruptions and other charges, he told.Prvious Chief Controller of KBCA Brig A.S Nasir and dozens of other KBCA officials were arrested and booked by Anti Corruption Authorities of Karachi on corruption Charges also.Even in 1996 when the Sindh Government was dissolved by the then Governor of Sindh , The Corruption of KBCA officials was included in the main reasons for the dissolving of Sindh Government by the Governor of Sindh in 1996.In fact KBCA was termed as a Nest of Corruption In the dissolving order of SIndh Government in 1996
Editor Further told colleague media men that One year has been passed since the filing of 20 Criminal and Civil ,frivolous false cases by the then Chief Controller of Karachi Building Control Authority for writing the corruption stories with substantiated proves against the corrupt practice of KBCA officials.
These cases were filed in the Sindh High Court and Lower Court of Karachi just to pressurize, punish and stop the Editor of Yahoo News, Mr.Tausif Hanif to further write against the Corrupt KBCA officials.
The First Civil Suit 1594/2007 was specially filed in the court of a PCO Judge Mr, Qazi Khalid .That judge had worked as a lawyer of KBCA authority in past and had been given hefty fees for that. In normal practice the judges never hear cases of the parties for which they had worked and had been paid in the past. But that Judge purposefully heard the case and in the very first hearing of case granted stay order till the disposal of Suite ,in favor of Corrupt KBCA Officials and barred the Editor of Yahoo News to further publish any News against the Corrupt KBCA officials. It may be noted here that PCO Judge Qazi Kahlid has served as a minister in Sindh Government in the past and he was actively involved with a certain political party.It should be noted that PCO Judge Qazi Khalid was nominated as accused in various criminal cases and he was even declared absconder in a murder case of Chairman of Board of Education of Karachi.There were many FIRs registered against PCO Judge Qazi Khalid.
Editor of Yahoo News Mr.Tausif Hanif asked the Judge that he should be given time for hiring the lawyer and preparation of case. But the PCO Judge granted stay order in favour of Corrupt KBCA Officials till the disposal of Suite!
It may be noted here that one Judge of Lower Courts of Karachi had also issued arrest warrants against the Editor of Yahoo News in a criminal defamation case filed in lower court by the Then Chief controller of KBCA Rauf Akthar Farooqui. In that case Yahoo News Editor obtained bail from the concerned lower Cout.
Few months ago, After the Change of Government then Chief Controller of KBCA Rauf Akhter Farooqui was removed from the department of KBCA by the PPP Provincial Miniseter for Local government Agha Siraj Durrani and an other Corrupt officer Mr, Manzoor Abdul Qadir Kaka was appointed as a Chief Controller of KBCA due to his linkage and support for PPP.
New Chief Controller of KBCA Manzoor Abdul Qadir Kaka has been also working like his predecessor and has not taken back these fales cases which were initiated and filed by the Ex CCOB of KBCA Rauf Akhtar Farooqui .New Chief of KBCA was remained the blue eyed boy of Ousted Chief Controller of KBCA Rauf Akthar Farooqui.Present Chief Controller of KBCA Manzoor Abdul Qadir alias KAKa has been running cases against the Yahoo News as like his earlier boss in full swing"
Yahoo News once again maintain that ,Yahoo News would never accept any pressure from The corruption mafia of KBCA and their supporters in crimes.
Editor Yahoo News further appealed to the National and International Media organizations to lodge and register their protest to the Government of Pakistan, as he has been victimized only for the publishing of alleged corruption of KBCA officials.
It may be noted here that Yahoo News has strong reservations against the PCO Judge Qazi Khalid and Editor of Yahoo News does not have confidence on that judge but the KBCA mafia managed to fix the hearing of case 1594/2007 in the court of Qazi Khalid on 13-4-2009.Since the Editor of Yahoo News does not expect any justice from that judge so he did not appear in his court. Editor of Yahoo News has been submitting an application under section 151, CPc for transferring of that case from the court of Qazi Khalid to any other judge of Sindh High Court . Next hearing date of that case has been fixed on 25-6-2009. So lets see what comes next !

Media man still under curbs in Pakistan

Karachi : Arrests warrants of Editor of Yahoo News ,Tausif Hanif has been issued by the Judicial Magistrate.South Rubab Fatima in a defamation criminal case filed by the Chief Controller of Karachi Building Control Authority,Rauf Akthar Farooqui.
Chief Controller of KBCA Rauf Akthar Farooqui filed a criminal defamation case,361/08 in the Court of Judicial Magistrate South Rubab Fatima ,claming that the Editor of Yahoo News wrongly published news against the allegedly corruption of KBCA officials and Chief Controller of KBCA.Chief Controller of KBCA in his case made DO Cordination of DCO Karachi ,Syed Mukaram Sultan Bukhari a respondent too, and arrests warrants for DO Syed Mukaram Sultan Bukhari also has been issued by the JM South Rubab Fatima in a similar way.
It may be noted here that Chief Controller has earlier filed a defamation Civil Suit 1594/07 in the Sindh High Court claming 5 crore rupees as a damages for publishing news against his alleged corruption in Yahoo News, on the direction of Chief Controller Four other Town Building Controllers of KBCA have also filed defamation suits(134/08.33/08.34/08) in Sindh High court during previous days. Half of Dozens Cases have been filed against the Editor of Yahoo News by the Chief Contoller of KBCA Rauf Akthar Farooqui and his subordinates Town Building Control Officers.Chief Controller issued alleged directions to all 18 Town Building Control Officers for the filings of cases against the Editor of Yahoo News.

I have been publishing a weekly English Newspaper namely, “Yahoo News” from Karachi since 15th July .2007. Various factual reports have been published about the miss deeds and corruption of KBCA officials specially the many wrong doings of Chief Controller of KBCA Rauf Akhtar Farooqui and his official and non officials accomplices in “Yahoo News” Newspaper.
CCOB farooqui asked me repeatedly not to publish any adverse news about him or any official of KBCA, he issued many threats to me and my paper.He repeatedly issued different types of threats to me . CCOB Farooqui issued these threats since the publication of first story against him in Yahoo News since 15th July 2007. Then his accomplices on gun point threatened to kill me and other journalists.
I rejected his threats and kept publishing the wrong doings of him and his accomplices in Yahoo News.
Then in December 2007, CCOB Farooqui filed a defamation suit (Civil Suit –1594) in Sindh High Court by using Public money and resources. That case was file by the Official lawyer of KBCA and huge amounts have been issued illegally for the filing of case from the accounts of KBCA. He filed that case to harass and stop me of publishing factual stories against him.
I sent many applications to the high ups of Karachi police and New Town Police Station asking for the provision of protection and registering of FIR against CCOB Farooqui and his accomplices but till date no FIR has been registered against them.
On my written complaint ,CCOB Rauf Akthar Farooqui was asked to give his statement by the SHO of News Town Police station Mumtaz Ali Shah on the direction of high ups of Karachi police. CCOB Farooqui was infuriated when he came to know that I had sent applications against him to various high up of Karachi Police and other concerned officials, so to take revenge and further harass me he issued directions to the KBCA lawyers to initiate false criminal proceedings against me in the district courts of Karachi.
Few days ago on the directive of CCOB Farooqui, various criminal proceedings have been initiated against me in the session courts of Karachi, just to harass me. Now CCOB Rauf Akhtar Farooqui has been trying to lodge multiple FIRs against me. It may be noted that I had stated (in my all applications sent to high up of government and even to the Chief Justice of Sindh High Court few months ago ) that CCOB Farooqui would try to file criminal cases against me to take revenge from me for publishing news against his corruption as he repeatedly threatened me that he would file false cases against me.
CCOB Farooqui issued threats to me many times directly and through various phone calls. Many of his armed official and non official accomplices also threatened and attempted to attack me in the vicinity of Civic Centre and other areas of Karachi.
On 5th December CCOB Farooqui sent many armed employees of KBCA to attack me in the vicinity of Civic Centre , Hassan Square but they could not find me as some one alerted me in time about this action, But the armed 30 employees who were mostly the Building inspectors of KBCA attacked and manhandled many journalists who were present in the vicinity of civic centre at this time, these elements beaten up many Journalists and asked them not to come in civic centre again. These armed attackers threatened that they would kill the journalists if any journalists dare to come again in the vicinity of KBCA.
Various threats have also been issued to me by various officials of KBCA on the directives of CCOB KBCA ,Rauf Akhtar Farooqui.
It may be noted that various FIRs have been lodged during previous years against the KBCA Officials,who targeted , attacked and kidnapped Journalists in different areas of Karachi.These FIRs and police entries have been lodged by targeted Journalists.(for details see the attached original copie of Yahoo News)
Due to repeated life threats and other type of pressure tactics, I have not been able to go to my office and perform my professional Journalistic duties for many months ,resulting serious loss to my Newspaper and income of Newspaper.I am practically not allowed to come easily into the head office of City Government and other related offices as when ever I try to reach there , armed men intervened and started to harass me.
I want to make it clear that if any type of harm is done to me or any member of Yahoo News ,then the CCOB Rauf Akhtar Farooqui and his accomplices would be fully jointly responsible for that. And proper FIRs should be lodged against them. I have provided the list of his accomplices to law enforcement agencies.
I have been in the field of practical journalism for more than 15 years, I have been working in Daily Financial Post , Daily leader. The Nation London, weekly Takbeer and Daily Ummat and other leading Newspapers of Pakistan during previous 15 years.
You are requested to intervene into the matter on urgent basis and issue appropriate directives.

CCOB Farooqui issued these threats since the publication of first story against him in Yahoo News since 15th July 2007. Then his accomplices on gun point threatened to kill me and other journalists.
I rejected his threats and kept publishing the wrong doings of him and his accomplices in Yahoo News.
Then in December 2007, CCOB Farooqui filed a defamation suit (Civil Suit –1594) in Sindh High Court by using Public money and resources. That case was file by the Official lawyer of KBCA and huge amounts have been issued illegally for the filing of case from the accounts of KBCA. He filed that case to harass and stop me of publishing factual stories against him.
I sent many applications to the high ups of Karachi police and New Town Police Station asking for the provision of protection and registering of FIR against CCOB Farooqui and his accomplices but till date no FIR has been registered against them.
On my written complaint ,CCOB Rauf Akthar Farooqui was asked to give his statement by the SHO of News Town Police station Mumtaz Ali Shah on the direction of high ups of Karachi police. CCOB Farooqui was infuriated when he came to know that I had sent applications against him to various high up of Karachi Police and other concerned officials, so to take revenge and further harass me he issued directions to the KBCA lawyers to initiate false criminal proceedings against me in the district courts of Karachi.
Few days ago on the directive of CCOB Farooqui, various criminal proceedings have been initiated against me in the session courts of Karachi, just to harass me. Now CCOB Rauf Akhtar Farooqui has been trying to lodge multiple FIRs against me. It may be noted that I had stated (in my all applications sent to high up of government and even to the Chief Justice of Sindh High Court few months ago ) that CCOB Farooqui would try to file criminal cases against me to take revenge from me for publishing news against his corruption as he repeatedly threatened me that he would file false cases against me.
CCOB Farooqui issued threats to me many times directly and through various phone calls. Many of his armed official and non official accomplices also threatened and attempted to attack me in the vicinity of Civic Centre and other areas of Karachi.
On 5th December CCOB Farooqui sent many armed employees of KBCA to attack me in the vicinity of Civic Centre , Hassan Square but they could not find me as some one alerted me in time about this action, But the armed 30 employees who were mostly the Building inspectors of KBCA attacked and manhandled many journalists who were present in the vicinity of civic centre at this time, these elements beaten up many Journalists and asked them not to come in civic centre again. These armed attackers threatened that they would kill the journalists if any journalists dare to come again in the vicinity of KBCA.
Various threats have also been issued to me by various officials of KBCA on the directives of CCOB KBCA ,Rauf Akhtar Farooqui.
It may be noted that various FIRs have been lodged during previous years against the KBCA Officials,who targeted , attacked and kidnapped Journalists in different areas of Karachi.These FIRs and police entries have been lodged by targeted Journalists.(for details see the attached original copie of Yahoo News)
Due to repeated life threats and other type of pressure tactics, I have not been able to go to my office and perform my professional Journalistic duties for many months ,resulting serious loss to my Newspaper and income of Newspaper.I am practically not allowed to come easily into the head office of City Government and other related offices as when ever I try to reach there , armed men intervened and started to harass me.
I want to make it clear that if any type of harm is done to me or any member of Yahoo News ,then the CCOB Rauf Akhtar Farooqui and his accomplices would be fully jointly responsible for that. And proper FIRs should be lodged against them. I have provided the list of his accomplices to law enforcement agencies.
I have been in the field of practical journalism for more than 15 years, I have been working in Daily Financial Post , Daily leader. The Nation London, weekly Takbeer and Daily Ummat and other leading Newspapers of Pakistan during previous 15 years.
You are requested to intervene into the matter on urgent basis and issue appropriate directives.

SHC restrains Yahoo News
Karachi, January 30: The single bench of Sindh high Court comprising Justice Qazi Khalid has directed the Editor of Yahoo News,Tausif Hanif to restrain publishing any news against Chief Controller of KBCA Rauf Akthar Farooqui or KBCA in Yahoo News.
The SHC single bench was hearing the initial hearing of the defamation suit filed by the Chief Controller of KBCA Rauf Akthar Farooqui for the damages claims of 50 million rupees against the publishing of news against him in Yahoo News.A weekly English Newspaper.
Chief Controller of KBCA stated in his Civil Suit no.1594/2007 that Editor of Yahoo News Tausif Hanif has been publishing news items in Yahoo News, which allegedly defamed him and his department.
Editor of Yahoo News , Who appeared in the court on 30th January on the date of hearing contended that he was not given any notice or official information about the hearings of that suit against him and he came to know about the hearing date from his sources few days ago. So the SHC bench was requested to give him a two months time for hiring of lawyer and preparation of case. The Editor further asked the court to give the case documents which was file against him in SHC By the KBCA Chief. Editor further Stated in the court that the court notices were being sent to the old address of Yahoo News,alhtough he had placed notice on the wall of old address of Yahoo News about the change of address and contact Cell phone number of Editor was also written in that notice board. The declaration of change of address was also printed in the December 2008 issue of Yahoo News prominently but no court notice or intimation was given to him. Editor of Yahoo News told that he came to know few days ago that previously two hearings were held in his absence on 12th and 17th January, 2008 respectively, and he was not informed about these two hearings by any means from the court about the hearings of that case.
Justice Qazi khalid of single bench of SHC ordered the Editor of Yahoo News not to publish any news against KBCA Chief Rauf Akthar Farooqui and KBCA in Yahoo News.The Editor of Yahoo News requested the Court that since he was not given any chance of fair hearing through his lawyer so the court should not restrain him from publishing factual reports against KBCA and its chief.
But the single bench of Justice Qazi Khalid directed the Editor not to publish any news against the CCOB of KBCA Rauf Akthar Farooqui or KBCA till the disposal of case.
Justice Qazi Khalid said in the open court that the KBCA lawyer does not the Law as if he knew the law he would have filed a defamation criminal case in sessions court against the Editor of Yahoo News and would obtained warrants of arrests against the Editor from the session Court..
The SHC single bench was requested by the Editor of Yahoo News to restrain the KBCA Chief Controller for filing frivolous cases in different court and issuing threats and using unfair means just to exert pressure on a Newspaper.
The Court observed that no Newspaper or Journalist could be given permission to defame any respected citizen. In reply of that Editor of Yahoo News Tausif Hanif told the court that he has publishing the factual reports against the official malpractice of KBCA and its officials and did not publish any private matter of KBCA Chief .He pointed out that KBCA Chief Rauf Akthar Farooqui was suspended in corruption charges by The Chief Minister of Sindh in 1996 after receiving credential reports against his corruption and the pervious Chief of KBCA was also indicted in the Anti Corruption court and was removed from the KBCA on these charges by the consent of the Competent authorities.
But the Court issued stay order against the Yahoo News and directed the Editor of Yahoo New not to publish any news against KBCA Chief Rauf Akthar Farooqui and KBCA till the disposal of case.
The hearing was adjourned for a month and the office of the SHC would fix next date.
Editor of Yahoo News told newsmen that He would file review petitions in larger bench of SHC against the SHC single bench order as that order was passed without giving him the chance of submission of his written replies through a lawyer and he was not given the fair chance of hearing or time for hiring of lawyer. He contended that court order was passed without given him any chance of hearing through a lawyer and he would file a petition in SHC after having the written certified orders of court.
Editor of Yahoo News further told that Freedom of speech and writing has been insured in the Article of Pakistan in section 199 of the article and honorable Courts are bound to ensure the freedom of press according to the article of Pakistan ,and he would file the review petition in the SHC against the order of Single bench to vacate the stay order against Yahoo News and change of the bench of the defamation Suit no.1954/07.It may be noted here that the defamation suit was file in December,2007 by the Chief controller of KBCA by using officials resources and funds of KBCA.
KBCA Chief files frivolous cases against Yahoo News’Editor
Karachi: Various Civil suits and criminal proceeding cases have been filed against the Editor of Yahoo News.Tausif Hanif by the Chief Controller of Karachi Building Control Authority,Rauf Akthar Farooqui in the Sindh High Court and Sessions courts of Karachi respectively after the publishing of corruption stories against CCOB of KBCA and other officials in Yahoo News, a weekly English newspaper of Karachi.

Chief Controller of KBCA Rauf Akthar Farooqui has filed a Civil Suit no.1594/2007 in the Singh High Court under the defamation ordinance of 2002, demanding 50 million rupees as damages from the Editor of Yahoo News,Tausif Hanif for publishing of miss deeds and corrupt practice of his and other KBCA officials.
CCOB of KBCA,Rauf Akthar Farooqui in his Civil suit and criminal proceedings cases, claimed that he is the most honest officials of KBCA and KBCA is also the most honest and efficient department of government. He further claimed that Editor of Yahoo News tarnished the honest image of his and his department by published corruption stories against the KBCA in Yahoo News. He claimed that KBCA is facing financial loses due the publishing of news against the corruption of KBCA officials in Yahoo News. He prayed to the Sindh High Court that he should be paid 50 million rupees by the Editor of Yahoo News as a damages for alleged tarnishing of his image as an honest official.
It may be noted here that Chief Controller of KBCA,Rauf Akthar Farooqui was suspended on corruption charges by the then Chief Minister of Sindh in 1996 ,after receiving credentials reports of his corruption from various government circles.
And the previous Chief Of KBCA Brig.A.S Nasir and other two dozens senior officials of KBCA were arrested by Anti Corruption Establishment and put behind bars on corruption charges, Various Substantiated FIR’s were registered against these officials and they were indicted by the Anti Corruption Court of Karachi few months ago.These officials are on bail presently.
KBCA Chief Controller further filed a private direct criminal proceeding complain in the Court of Judicial Magistrate.South,Rubab Fatima ,against the Editor of Yahoo News. Chief controller of KBCA Rauf has initiated that private criminal proceeding case under section 200 of Cr.Pc read with section 499/500 of Pakistan Penal Code. Farooqui has filed that private complained by using the KBCA lawyer, officials funds and giving power of Attorney to the Assistant Public Relation officer of KBCA Amjad Ali for filing the case.
Chief Controller of KBCA claimed in that private complain of him that Editor of Yahoo News, Tausif Hanif has tarnished his neat and clean image by publishing news against him in Yahoo News. Chief Controller Farooqui requested the Court to issue arrests warrants against the Editor of Yahoo News,Tausif Hanif and put him behind the bars on the charges of publishing of news against corrupt practice of KBCA and its Chief Controller.
It may be noted here that Editor of Yahoo News Tausif Hanif has been working in various leading Newspaper of Pakistan for more than 15 years and he there was no case of any type against him in his lengthy journalistic career , He has been working in Daily Financial Post , Daily leader. weekly Takbeer and Daily Ummat and other leading Newspapers of Pakistan during previous 15 years
